Internet Access
Independent Youth Resource Centre provides access to the internet where you can
do surf the net for research, create your resume and email. Our Acceptable Use Policy
is intended to enhance the use of our Internet services by preventing unacceptable
uses. By accessing our Internet services you are agreeing to the terms and
conditions that appear below.
Disclaimer/Warranties:
Cafe Client's Internet access is provided “as is” with no guarantees, and
no warranties of any kind. We are not liable to any customer for any harm
that may occur through his/her use of our services, regardless of fault.
Unacceptable Conduct:
You will use our services in an acceptable manner. If any customer, at the
discretion of IYRC, is found to be using our services in an unacceptable manner,
the offending customer's account may be cancelled without notice. Behaviour
which is unacceptable and may result in cancellation includes, but is not limited
to:
• Illegal Use: Using our services to transmit any
material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally,
violates any applicable local, state, national or international law, or any rules
or regulations promulgated hereunder.
• Security: Using the facilities of IYRC to access
or to attempt to access the accounts of others, or to penetrate or to attempt to
penetrate security measures of IYRC or another entity's computer software or hardware,
electronic communications system, or telecommunications system, whether or not the
intrusion results in the corruption or loss of data.
• Inappropriate Material: Using IYRC services as a
means to advertise, transmit, store, post, display or otherwise make available material
that is offensive, abusive, unlawful, harmful to minors, threatening, harassing,
defamatory, vulgar, graphic, violent, pornographic, libellous, invasive of another's
privacy, or racially or ethnically offensive or threatening.
• Copyright and Trademark Infringement: Using IYRC
services to transmit any material (by email, uploading, posting, or otherwise) that
infringes any copyright, trademark, patent, trade secret, or other propriety rights
of any third party, including, but not limited to, the distribution of photographs
from magazines, books or other copyrighted sources, and the unauthorized transmittal
of copyrighted software.
• Distribution of Internet Viruses, Trojan Horses, or Other Destructive
Activities: Knowingly distributing information regarding the
creation or sending internet viruses, worms, Trojan horses, pinging, flooding, mail
bombing, or denial of service attacks, or any other activity which adversely affects
the ability of other people to use IYRC services. Customers may not, through
action or inaction, allow others to use their access for illegal or inappropriate
actions. A customer may not give their access, through action or inaction,
to be configured in such a way that gives a third party the capability to use their
access in an illegal or inappropriate manner.
• Collection of Personal Data: Using IYRC services
to collect or attempt to collect personal information about third parties without
their knowledge or consent.

Privacy:
IYRC respects customer privacy. We do not disclose personal information we
may receive to any third party unless requested by the customer. In balancing
the customer's right to privacy with IYRC need for a safe environment for all customers,
we may but have no duty to monitor each customer's use of our services. As
a general rule, IYRC does not routinely inspect, monitor or disclose content.
However, customers using our services consent to being monitored and are advised
that if the monitoring process reveals evidence of criminal activity, IYRC may provide
the content and transmission details to authorities as appropriate. In the
course of service maintenance or performance monitoring, the activities of individuals
using the service may be monitored, however, IYRC has no duty to monitor the customer's
usage of the Internet.

Sharing:
IYRC will not share any personal information about any customer or the customer's
use of our system to any third party except: (a) to conform with the law or comply
with legal process served on IYRC; (b) to protect and defend the rights or property
of IYRC; (c) to enforce our policies; or (d) if IYRC reasonably believes that exigent
circumstances exist which would require IYRC to protect the safety of any person.
Filtering:
IYRC may employ filtering software and reserves the right to filter content that
the software identifies as unacceptable.

Email:
Only IYRC employees are entitled to an email address from IYRC. IYRC reserves
the right to either suspend or terminate customer's email access upon discovery
of any unacceptable conduct, including but not limited to any email that is offensive,
abusive, unlawful, harmful to minors, threatening, harassing, defamatory, vulgar,
graphic, violent, pornographic, libellous, invasive of another's privacy, or racially
or ethically offensive or threatening.
Termination:
IYRC may terminate this contract immediately, without notice, if a customer breaches
any of the terms and conditions of this agreement.
Modification of Acceptable Use Policy:
IYRC reserves the right to modify this Acceptable Use Policy at any time without
prior notification at our discretion. The responsibility to stay informed
of any changes to this policy remains solely on the customer. Use by the customer
after a change to this Acceptable Use Policy has been so posted by IYRC shall constitute
an acceptance by the customer thereof. If the customer does not wish to accept
such changes, the customer's only remedy is to terminate the services IYRC provides
to the customer under this contract within thirty days of the date such change is
posted. One intent of this Acceptable Use Policy is to ensure that all customers
of IYRC have the fullest protection from less than scrupulous individuals.
By conforming to this Acceptable Use Policy, all customers create an environment
where communication can flow freely and with a minimum of policing.
Indemnity:
IYRC wishes to emphasize once again that a customer's use of IYRC services will
constitute the customer's complete acceptance of IYRC policies and serve as a services
agreement. By and through this agreement, the customer will indemnify IYRC
for any violations of the agreement, law, or IYRC policy that may result in loss
to IYRC or the bringing of any claim against IYRC by any third party. This
means that if IYRC is sued because of a customer's activity, the customer will pay
any damages awarded against IYRC, plus costs and reasonable attorneys' fees.

of IYRC customers as responsible users of the Internet and email. IYRC reserves
the right to contact any customer regarding information pertaining to the use of
their account(s). Any complaints about a customer's violation should be sent
